Lease Audits

Ten decades advising real estate organizations of all types and sizes gives us the deep insights into the pitfalls, ambiguities, and nuances of leases to help clients realize cost savings. Successfully representing both tenants and landlords, we have performed hundreds of lease and lease escalation audits.  We know where to look to quickly uncover overcharges and both common and uncommon mistakes that can lead to refunds. Leveraging our real estate expertise gives us a clear picture of actual operating expenses for Class A and other types of properties.  Looking deeply at the all–important base year, we isolate variations that directly impact all future escalations.

For Tenants: We identify opportunities for savings — including finding overcharges, errors, and ways to reduce rental obligations.  We assist you in obtaining credits and refunds from the landlord.  In the process, we suggest ways to refine, clarify, and improve language in the lease.  We have also been involved in lease reviews where there were disputes between tenants and subtenants.

For Landlords: We verify whether the terms of the lease are being carried out — alerting you to potential underbillings.  If you have a participating interest, we review the tenant’s operating results to ensure they are complying with the lease.

For Landlords And Tenants: In negotiations, we cut through the complexities to find solutions agreeable to both parties and seek to limit or eliminate the expense of arbitration and litigation.

With our ability to digest and explain complicated lease clauses, we have been accepted as experts in many arbitrations and court proceedings.  In this role, we interpret all manner of financial clauses including the basis of accounting to be used — GAAP, income tax basis, accrual basis, or commonly used real estate accounting practices. We leverage our expertise to determine the industry norm with respect to lease terms and help identify the issues and resolve the dispute.
